O Estado/estado da democracia

Abstract

A História é espaço de livre arbítrio praticado pelo homem, o mercado sendo constituído pelo direito posto pelo Estado moderno. O Estado moderno não se confunde com o Estado hegeliano, estado da racionalidade como razão efetiva. É determinado por particularismos. A sociedade capitalista é essencialmente jurídica; o direito posto pelo Estado surge para domesticar determinismos econômicos. Esse Estado moderno ainda sociedade civil é incapaz de sustentar a democracia que existirá, no futuro, quando o espaço de livre arbítrio que constrói a História vier a ser exercido pelo todo social. Só então será produzida a utopia do homem amigo do homem.

L’Histoire est un espace de libre arbitre pratiqué par l’homme; le marché étant constitué par le droit posé par l’Etat moderne. L’Etat moderne ne se confond pas avec l’Etat hégélien, état de la rationalité comme raison effective. Il est déterminé par des particularismes. La société capitaliste est essentiellement juridique; le droit posé par l’Etat surgit afin de domestiquer des déterminismes économiques. Cet Etat moderne encore société civile est incapable de soutenir la démocratie qui existera, dans le futur, quand l’espace de libre arbitre qui construit l’Histoire sera exercé par le tout social. Ce n’est qu’alors que sera produite l’utopie de l’homme ami de l’homme.

History is a place where human beings exercise free will, the market encompassing the law laid down by the modern State. The Modern State is not the same as the Hegelian State, the state of rationality as a real reason. It is guided by particularisms. Capitalist society is mostly legal; the State lays down laws to tame economic determinism. This modern State, yet civil society, is incapable of sustaining the democracy arising in the future, when the space of free will which history constructs is exercised by the whole of society. Only then will the utopia of mankind as the friend of mankind arise.
