século XX, o funcionamento
das sociedades nas quais vigoraram
regimes não ditatoriais.
Identificam-se três grandes
sub-períodos: demoliberalismo,
estado social de direito e
globalização neoliberal.
Considerando, antes de
mais, a produção intelectual
alemã, francesa e italiana,
analisa-se o modo como os
interesses dominantes em
cada conjuntura são transpostos
para os discursos filosófico,
jurídico e político.
Destaca-se, finalmente, a
similitude entre as soluções
defendidas nas primeiras
e nas últimas décadas do
século XX, o que pressupõe
a recusa do estado social de direito e do “Estado-
-Providência”. Dans cet article, nous cherchons à analyser les présupposés philosophiques et idéologiques des normes juridiques et politiques qui encadrent, au long du XXe siècle, le fonctionnement des sociétés dans lesquelles sont en place des régimes dictatoriaux. Nous identifions trois grandes sous-périodes: démo-libéralisme, état social de droit et globalisation néolibérale. En considérant, avant tout, la production intellectuelle allemande, française et italienne, nous analysons la façon dont les intérêts dominants dans chaque conjoncture sont transposés dans les discours philosophique, juridique et politique. Nous mettons, finalement, en exergue la similitude entre les solutions défendues dans les premières et les dernières décennies du XXe siècle; ce qui présuppose le refus de l’état social de droit et de l’“Etat-Providence”. The present paper intends to analyse the philosophical and ideological assumptions of the legal and political standards which, during the 20th century, governed the functioning of societies that had non-dictatorial regimes. Three large sub-periods have been identified: demoliberalism, social state under the rule of law and neoliberal globalisation. Considering firstly German, French and Italian intellectual production, we look into how dominant interests in each context are translated into philosophical, legal and political discourse. Finally, the similarities between the solutions advocated in the early and the last decades of the 20th century are highlighted, which presupposes the denial of the rule of law and of the “Welfare State”. |
