A relação entre o estado e o indivíduo a partir da filosofia do direito de Hegel

Abstract

This chapter is intended to present succintly the fundamental concepts, although partially, which will allow minimal comprehension of the kind of relation Hegel stablishes between the individual and the State, counterpointing and articulating dialectically the concepts of Subjective will (principle of particularity) and the concept of Universal will (principle of universality) represented by the concept of State. The present work, aims to show how Hegel, with his theoretical instrumental, articulates these two principles and how since this theoretical comprehension he develops the conception of State and, at the same time, criticizes those theoretical conceptions which intend to found the State in the contract.

Neste capítulo pretende‑‑ se apresentar sucintamente os conceitos fundamentais, embora de forma parcial, que permitem compreender minimamente o tipo de relação que Hegel estabelece entre indivíduo e Estado, contrapondo e articulando dialeticamente, o conceito de vontade subjetiva (princípio da particularidade) e o conceito de vontade universal (princípio da universalidade) representada pelo conceito de Estado. O presente trabalho visa, portanto, mostrar como Hegel com seu instrumental teórico articula esses dois princípios e como a partir dessa compreensão teórica desenvolve sua concepção de Estado e, ao mesmo tempo, critica aquelas concepções teóricas que pretendem fundar o Estado no contrato.
