O direito e a imaginação antropológica da cultura europeia do início da era moderna

Abstract

Juristas e leigos têm a comum atitude de encarar o direito como um saber técnico, cortado da história e das imagens profundas em que baseia cada cultura. Uma das vocações mais importantes da história do direito é justamente a de mostrar como o direito deve, pelo contrário, ser objeto de um estudo cultural. Neste artigo, o direito aparece como uma manifestação de imagens comuns e de longa duração acerca do mundo e da sociedade. Uma das mais marcantes é a de que o mundo em geral e, em concreto, o mundo humano são uma unidade orgânica, semelhante à do corpo. A transferência de saberes sobre o corpo dos homens e dos animais para o corpo político é constante, aproximando o direito e a política da medicina, os juristas dos médicos, tanto no seu saber, como nas técnicas intelectuais de o atingir.

Lawyers and lay people have the common attitude of considering law as a technical knowledge, cut off from history and the deep imagery upon which each culture is grounded. One of the most important vocations in history of law is precisely to show how law shall, on the contrary, be the object of a cultural study. In this article, law appears as a manifestation of common and long-term images about the world and about the society. One of the most striking assumptions is that the world, as a whole, and the human world in particular form an organic unit, similar to individual bodies. The transfer of knowledge about the body of men and animals to the body politic is constant, approaching law and politics to medicine, lawyers to doctors, both in their knowledge, as in the intellectual techniques of reaching it.
