La primera regulación sanitaria española: la ley orgánica de 1855

Abstract

La creación de instituciones sanitarias afectó a todos los territorios de la Corona española, aunque el traslado de las nuevas normativas no se llevó a cabo de forma homogénea. La distancia, el contexto y las ansias independentistas fueron factores que incidieron en la implantación en estos lugares. Situándonos en el escenario político isabelino, hemos estudiado el entorno socio-sanitario junto al análisis de la ley y el debate parlamentario que la generó. Para ello, profundizamos en la situación y los cambios en las instituciones de sanidad desde el Antiguo al Nuevo Régimen, e identificamos los aspectos innovadores de la nueva normativa legal comparándola con la no promulgada de 1822. El análisis del debate en sede parlamentaria durante el Bienio Progresista (1854-1856) permitió identificar los aspectos más controvertidos que surgieron en la discusión.

The creation of sanitary institutions applied to all the territories of the Spanish kingdom, although the execution of the new regulations was not homogenous, since the distance, the context, and the pro-independence feelings could distort their actual introduction. Focusing on the Isabellin period, we have studied the socio-sanitary context and the parliamentary debate which gave light to the new law, delving into the situation of the sanitary institutions and the changes they experienced from the Old Regime, thus identifying the most relevant innovations in comparison with the non-promulgated law of 1822. The analysis of the parliamentary debate during the Progressive Biennium (1854-1856) has allowed us to identify the most controversial points in the discussion.
