O problema da representação e a construção do povo: algumas notas sobre a actualidade do debate Schmitt versus Kelsen

Abstract

O presente artigo procura reflectir sobre os problemas da representação e da construção de um sujeito político colectivo em sede de teoria da democracia. Através da revisitação do debate weimariano entre Carl Schmitt e Hans Kelsen, intentaremos demonstrar que o conceito de representação, frequentemente ignorado ou subapreciado pela literatura, constitui estimulante ponto de partida para pensar as dimensões colectiva e agonística da política democrática. Tais dimensões afiguram-se-nos cruciais para uma teoria política que se pretenda situar fora da órbita restritivamente individualista do pensamento liberal.

This article seeks to reflect upon the problems of representation and the construction of a collective subject of politics in the context of democratic theory. By revisiting the Weimar debate between Carl Schmitt and Hans Kelsen, we will try to demonstrate that the concept of representation, whilst often overlooked or underappreciated in the literature, is a stimulating point of departure for thinking about the collective and agonistic dimensions of democratic politics. These dimensions are crucial for a political theory that wishes to leave the orbit of a narrowly individualistic liberal thought.
