Sociedade e Estado: reflexos krausistas

Abstract

Aadopção do krausismo no Curso de Direito da Universidade de Coimbra actualizou o magistério do Direito Natural. Trouxe novas noções e novos valores para o mundo que estava ali. A seu modo incamou-os e transmitiu- -os, dando início à contemporaneidade, não só do ponto de vista jurídico, mas também no campo da educação e no âmbito da política. A abordagem deste texto favorece este último aspecto (talvez o menos estudado), nomeadamente quanto às ideias de sociedade e estado que veicula. Recorre para isso ao pensamento de H. Ahrens e de G. Tiberghien para avaliar a recepção que teve em Portugal e como esta se reflectiu no modo de pensar dos seus discípulos Vicente Ferrer, Dias Ferreira e Rodrigues de Brito. E daí qual a alternativa política que transparece dos seus ensinamentos numa época marcada por potenciais e reais mudanças.

By adopting krausism Coimbra University's Law Degree Course updated the teaching of Natural Law. It introduced new notions and new values for the world which was there. In its way it embodied them and transmitted them, initiating contemporaneity, not only from a juridical point of view, but also in the field of education and in the scope of politics. This paper focuses on this last aspect (perhaps the one that is least studied), namely as to the ideas of society and the state which embodies them. To do this it turns to the thought of H. Ahrens and G. Tiberghien to evaluate the reception it had in Portugal and the repercussions it had on the way of thinking of its followers Vicente Ferrer, Dias Ferreira and Rodrigues de Brito. And thence what is the political alternative which appears though its teaching during an epoch marked by potential and real changes.
