Do Estado: da construção à desconstrução do conceito de Estado-Nação

Abstract

Neste artigo analisa-se o processo de construção da ideia do Estado desde o século XIV (a partir das teorias de Marsílio de Pádua e de Guilherme de Occam) até à paz de Westphalia, para, de seguida, analisar a homologia entre as formas de Estado capitalista - absolutista, liberal e social de direito - e os modelos de relações internacionais dominantes em cada época histórica - o modelo Westphaliano, SdNiano e Onusino - com vista a demonstrar que ao Estado absolutista corresponde o modelo de relações internacionais Westphaliano, ao Estado liberal correspondente o modelo SdNiano de transição e ao Estado social de direito corresponde o Onusino, defendendo que, efectivamente e ao contrário da tese propugnada por vários autores, o modelo Westphaliano não perdurou até à Segunda Guerra Mundial. Nessa mesma análise procura-se revelar que o processo de desconstrução da ideia de Estado e de construção de novos aparelhos de inscrição do poder político tiveram já o seu início, anunciando a crise da ideia de Estado.

This article analyses the process of the construction of the idea of the State going back to the 14th century (following the theories of Marsilio of Padua and William of Occam) until the peace of Westphalia and then analyses the homology between the capitalist forms of state - the absolutist, the liberal, and the social state governed by the rule of law - and the models of international relations which dominated in each period of history - the Westphalian, the League of Nations, and the UN models - with a view to demonstrating that the absolutist state corresponds to the Westphalian model of international relations, the liberal state corresponding to the League of Nations model of transition and the social state governed by the rule of law corresponding to the UN model, claiming that, in fact and in contradiction to the argument put forward by various writers, the Westphalian model did not last up to the Second World War.
