Heteronormatividades: formas de violência simbólica e factual com base na orientação sexual e identidade de género

Abstract

Em Portugal, a discriminação de pessoas com base na sua orientação sexual é um acto inconstitucional desde Abril de 2004. Contudo, esta mudança na Constituição tem tido escassos reflexos nos códigos sociais utilizados quotidianamente. Tal facto reforça a ideia de que uma transformação jurídica progressista tem um potencial limitado de transformação social, requerendo a articulação de iniciativas por parte da sociedade civil. Este artigo debruça-se sobre esta descoincidência entre códigos jurídicos e práticas sociais, tendo por base a violência física e simbólica dirigida a gays, lésbicas e bissexuais em Portugal após a alteração constitucional. Identificando factores, actores e acontecimentos, pretende-se reflectir sobre o regime heteronormativo enquanto prática socio-política e avaliar o seu impacto sobre o presente contexto de violência homó- foba em Portugal.

In Portugal, discrimination based on sexual orientation is against the Constitution since April 2004. However, this change in the Constitution had little translation in daily social praxis. Thus, it becomes clear that a progressive legal change has a limited power to generate social change, requiring further articulation of actions in the sphere of civil society. This paper examines the lack of coincidence between legal codes and social praxis, based on physical and symbolic violence against gays, lesbians and bisexuals in Portugal after the Constitutional change. After identifying factors, actors e events, the general aim is to analyse the heteronormative regime as a social and political praxis and evaluate its impact over the present context of homophobic violence in Portugal.
