O pacto político como fundamento do poder

Abstract

É frequente, nos teóricos e defensores do sistema liberal vintista, no contexto do Estado de direito, o recurso à história pátria para tentar comprovar que os conceitos de liberdade civil e política, de direitos fundamentais do homem e do cidadão, de representatividade parlamentar, de soberania da nação, entre outros, bem como as instituições políticas que lhes conferiram expressão, não constituíam produtos abstractos do espírito humano em época recente, mas emergências de uma realidade secular da nação. Os deputados vintistas pretendiam e conseguiram edificar um Estado de direito liberal. Eram, obviamente, sensíveis à modernidade. Não ignoraram a história da sua pátria. No plano da análise teórico-política do liberalismo, utilizaram-na, até certo ponto, com legitimidade. Mas queriam ultrapassá-la. Sabiam que a constituição que se empenharam em promulgar era, no sentido mais perfeito da palavra, um acto revolucionário.

Among the theoreticians and defenders of the liberal system of the 1820’s, it is frequent to examine, within the context of a state of law, the history of the fatherland so as to try to prove that the concepts of civil and political liberty, the fundamental rights of man and of the citizen, parliamentary representation and national sovereignty, among others (as well as the political institutions through which they expressed themselves, are not abstract products of the human spirit in recent times but, rather, they emerge from a secular reality of the nation. The members of the Portuguese parliament in 1820’s wanted and managed to build a state of liberal law. They were, evidently, sensitive to modernity. They did not ignore their country’s history. As far as the theoretical- political analysis of liberalism is concerned, they used it, to a certain extent, legitimately. But they wanted to surpass it. They knew that the Constitution which they were attempting to promulgate was, in the most perfect sense of the word, a revolutionary act.
