Os “forais novos”: uma reforma falhada?

Abstract

O texto procura repensar a chamada “reforma manuelina” dos forais, através de uma análise pormenorizada de alguns forais, com destaque para os de Entre Douro e Minho. Não só se recorda todo o aspecto político e processual que conduziu à outorga de novos forais, como se verifica que muitos deles não são verdadeiros forais mas, por vezes, simples listas de foreiros da Coroa. Faz-se um levantamento sumário de outras imperfeições jurídicas e diplomáticas destes documentos, que justificariam o título do artigo: uma reforma falhada.

This paper tries to reconsider the so called King Manuel I’s (1495-1521) reformation of the municipal charters, through a careful analysis of some of them (mostly those from the north of Portugal). We look into the whole political and juridical process of elaboration of those new charters, to conclude that a lot of them are not real charters, but simple lists of king’s tenants. A brief inventory of other diplomatic and juridical imperfections of those documents allows us to suggest the title of the paper: a famous reformation which was probably a missed opportunity.
