Os socialistas perante o infanticídio e o aborto

Abstract

O infanticídio e o aborto, enquanto delitos punidos pela lei, entraram na legislação portuguesa só com a promulgação do Código Penal em 1852, vigente até à reforma de 1982. O ingresso destes delitos nas normativas jurídicas representou uma profunda alteração conceptual do legislador relativamente à infância, uma vez que esta etapa da vida gozava de escassa consideração jurídica até essa altura, mas à qual os socialistas não foram alheios. A intelectualidade operária denunciou as condições laborais das crianças, mas também o recurso dos pais à morte dos filhos, fundamentalmente por motivos económicos. Neste artigo exploramos o quadro legislativo de Oitocentos no que diz respeito aos crimes de infanticídio e aborto, as circunstâncias da comissão do delito, e a leitura que deste tema se fazia nos meios operários socialistas.

Infanticide and abortion, as offenses punishable by law, entered into Portuguese law only with the enactment of the Penal Code in 1852, in force until the reform of 1982. The entry of these offenses into the legal regulations represented a profound conceptual change of the legislature with regard to childhood, since this stage of life enjoyed little legal consideration up to that point, but to which the socialists were not alien. Workers ‘intellectuality denounced the working conditions of children, but also the parents’ recourse to the death of their children, mainly for economic reasons. In this article we explore the legislative framework of the Eighth Centenary with regard to crimes of infanticide and abortion, the circumstances of the commission of the crime, and the reading of this theme in the socialist workers’ means.
