La relación sistemática del derecho y la moral en Fichte

Abstract

This paper analyses the relationship between morality and law in the practical philosophy as developed by Fichte. It starts with comparing the Fichtean understanding of the relationship between morality and law in the Grundlagen des Naturrechts nach Prinzipien der Wissenschaftslehre (1796/1797). This relationship between morality and law is further analysed as it is reflected upon by his later works, Rechtslehre 1812 and Staatslehre of 1813. The paper concludes by presenting the most significant similarities and differences in the treatment of the relationship between morality and law in both phases of Fichte’s practical philosophy.

El presente texto analiza la relación de la moral y del derecho en la filosofía práctica de Fichte. En primer lugar, se compara la comprensión fichteana de la relación entre moral y derecho en el Fundamento del derecho natural según los principios de la Doctrina de la Ciencia (1796/1797). En segundo lugar, se atiende a esta relación entre moral y derecho en la Doctrina del derecho de 1812 (Rechtslehre) y la Doctrina del Estado (Staatslehre) de 1813. Por último, se extraen las similitudes y las diferencias más importantes en el tratamiento de la relación entre moral y derecho en ambas fases de la filosofía práctica de Fichte.
