Nómos e aplicação em Gadamer: o papel da deliberação

Abstract

In this paper we defend, according with H.-G. Gadamer and P. Ricoeur, that nomos in ethics is flexible and requires hermeneutic application or translation, so that it should not be applied restrictively. Therefore, we demonstrate how ethics requires the care and the attention to the voice of the other. This is a process that implicates a hermeneutic of the rules, that maintains the coexistence in the common life and work, and demands also a translation of the rules for the present situation. In conclusion, the text explains how nowadays applied ethics demands tremendous effort of translation..In fact without translation, the rule is blind and its application can create tragic implications.

Defendemos com H.-G. Gadamer e P. Ricoeur que o nomos em ética é flexível, exige aplicação hermenêutica ou tradução, isto é, nunca uma aplicação constringente. Neste sentido, explicamos como a ética exige a atenção à voz do outro, implica uma hermenêutica das regras que mantêm a convivência na vida comum e nas profissões e uma tradução destas para a situação em causa. Concluímos demonstrando o grande esforço das éticas aplicadas dos dias de hoje: sem a tradução a regra é cega e a sua aplicação pode dar origem ao trágico.
