Abstract

The Roman road network, quite impressive in its size and the magnitude of the maintenance that it required, is rarely associated with written technical evidence. This obliges us to call on archaeology to remedy this striking information gap. A different situation characterizes the study of road legislation from the available juridical, literary, and epigraphic sources. These attestations elucidate the road network, including its public and private facets, clearly exemplifying an essential trait of Roman civilization, the use of law on behalf of the community.

A rede viária romana, impressionante tanto pela extensão e volume de trabalhos que exigiu, como pelas funções que lhe foram atribuídas, conta com raros testemunhos escritos de tipo técnico, obrigando a recorrer largamente à arqueologia para suprir esta surpreendente lacuna. Situação totalmente diferente é a que se refere às fontes disponíveis, jurídicas, literárias e epigráficas, para o estudo da legislação viária nas suas mais diversas vertentes, estatais, públicas e privadas, realçando claramente uma das características essenciais da civilização romana, o uso da Lei ao serviço da comunidade.
